1. To establish a basic system for ecological and environmental protection; to enforce environmental laws, regulations, rules, strategies, and policies; to formulate and implement environmental policies and local environmental regulations with related departments; to draft and supervise the implementation of the planning of key areas, watersheds, sea areas, sources of drinking water, etc.,as well as the district planning based on environmental functions; to set environmental standards; and to establish environmental criteria and technological norms with related departments.

2. To coordinate and supervise big environmental problems; to take the lead in the management of severe environmental pollution and ecological destruction accidents; to guide and coordinate all district governments to carry out contingency and warning work when severe environmental pollution accidents take place; to guide the compensation system on environmental damage; to coordinate with different regions to solve trans-region disputes on environmental pollution; and to coordinate environment protection in key areas, watersheds, and sea areas.

3. To make sure that the emission reduction goal is achieved; to organize, formulate and supervise the implementation of emission control plans for all kinds of land and sea pollution as well as the emission permission system; to find out the assimilative capacity of ambient air, water, and ocean; to supervise and check the performance of pollution emission reduction tasks; and to implement the target-oriented responsibility system on environmental protection.

4. To offer advice on the size and direction of fixed assets investment in the area of ecology and environment; to give suggestions on the financial arrangement for environmental projects; to cooperate with responsible agencies in organizing, implementing, and supervising relevant affairs; and to participate in the guidance of promoting circular economy and the ecological protection industry.

5. To supervise and manage the prevention and control of environmental pollution; to formulate and supervise the implementation of pollution control and treatment system on ambient air, waterways, ocean, soil, noise, radiation, odor, solid waste, chemicals, and motor vehicles; to help responsible agencies monitor and manage the affairs concerning environmental protection at drinking water sources; to organize and guide comprehensive rehabilitation on rural and urban ecology and environment; and to supervise and guide the non-point source pollution control in agricultural sector.

6. To guide, coordinate, and supervise the protection and restoration of the ecology system; to arrange the formulation of environmental protection plans; to supervise exploitation activities on natural resources which may have a negative ecological impact, important ecological construction, and ecological reclamation; to supervise the execution of the environmental monitoring system in all kinds of nature reserves; to supervise the protection of wildlife and the ecological environment in wetlands; to guide, coordinate, and supervise rural environmental protection; to supervise the environment safety of biological technologies; to organize and coordinate the protection of biological diversity; and to work on compensation for ecological protection.

7. To take charge of the administration and monitoring of nuclear resources and radiation; to formulate relevant policies, regulations, and standards; to take charge of work concerning radiation safety coordination system; to participate in dealing with nuclear emergencies; to take charge in dealing with emergent radiation accidents; to supervise and administer the safety of the radiation sources and devices; to supervise and administer the prevention of pollution from the application of nuclear technology, electromagnetic radiation, and the exploitation and application of concomitantly radioactive mineral resources; and to supervise and administer the design, manufacture, installation, and nondestructive testing of the application of nuclear technology.

8. To supervise and administer the admission of ecological environment. Commissioned to the municipal government, to assess the environmental impacts exerted by major economic and technological policies, plans of development, and major plans on economic development. To organize and implement the assessment system concerning environmental impacts exerted by regions, regulations, and projects, based on relevant national and municipal regulations. To formulate, organize, and implement the admission list for ecological environment; and to guide and coordinate the environmental management in the industrial parks.

9. To take charge of the monitoring work of the ecological environment; to formulate an environmental monitoring system and regulations and to implement them; to formulate and supervise the implementation of relevant standards; to plan with responsible agencies the setting of the monitoring stations of environmental quality; to organize and implement the monitoring of environmental quality, sources of pollution, emission reduction of greenhouse gases, and emergencies; to organize the establishment and management of a citywide environmental monitoring network and an environmental information network; to organize the survey, evaluation, prediction, and pre-warning about the environmental quality situation; to organize and draft the report on environmental quality; and to take charge of the release of information on ecology and environment.

10. To deal with climate change; to organize the formulation and implementation of major tasks, plans, and policies to deal with climate change and to reduce the emission of greenhouse gases; and to undertake the implementation of the UnitedNations Framework Convention on Climate Change in Shanghai.

11. To organize and carry out the inspection of environmental protection; to establish and perfect the inspection system of environmental protection; to organize and coordinate the work of inspecting environmental protection; and to inspect and offer accountability advice under authorization on the decisions and arrangements of national and municipal environmental protection implemented by every district and responsible agency.

12. To take charge of the supervision and law enforcement on ecology and environment; to organize and carry out law enforcement and inspection activities on environmental protection; to investigate and punish major violations of the environmental protection law; and to guide the building and the service of the comprehensive law enforcement team on environmental protection.

13. To organize, guide, and coordinate the promotion and education work on environment; to implement the promotional and educational guidelines on national environment protection; to promote social organizations and the public to participate in environmental protection; to carry out work on environmental technology; to organize major scientific research and technological engineering demonstration on environment; and to promote the establishment of a management system of environmental technologies.

14. To carry out international cooperation and communication on ecology and environment; to study and offer advice on relevant problems in international environmental protection cooperation; to organize and coordinate the implementing of international conventions on environment; and to participate in the handling of foreign ecological affairs.

15. To organize and coordinate the pollution prevention and control in the Yangtze River Delta region; to organize and study major problems concerning environmental protection in the Delta region; and to study and propose the priorities on regional coordination in joint pollution prevention and control.

16. To nominate and inspect Party and government leaders in district environment departments by coordinating with district organization departments; to enhance the examination of leaders in district environment departments on theperformance of their duties and the implementation of major policies; and to offer guidance to the Party construction work of district environment departments.

17. To complete other tasks assigned by CPC ShanghaiCommission and the municipal government.

18. The change of functions. The Shanghai Municipal Bureau of Ecology and Environment shall take it as its duty to monitor all kinds of ecological, rural, and urban pollution emissions, as well as to undertake administrative law enforcement; it shall fulfill its duty in supervision and inspection, to organize and implement the pollution prevention and control action planson ambient air, water, and soil sectors. It shall establish an environmental protection system that includes monitoring, supervision, law enforcement, and inspection; it shall implement the strictest environmental protection system. It shall establish an environmental governing system with the government as the leader, enterprises as the main body, and social organizations and the public as participants. It shall strictly hold the red line of environmental protection and the bottom line of environmental quality; and it shall secure ecological safety and build beautiful Shanghai.

19. The distribution of responsibilities

19.1. The distribution concerning the Shanghai Municipal Development and Reform Commission. The Shanghai Municipal Bureau of Ecology and Environment is responsible for the affairs that are relevant to the reduction of environmental emission, the formulation of relevant policies, the approval and examination of carbon indexes, while the Shanghai Municipal Development and Reform Commission is responsible for the coordination of the funding and policies on the environment and energy saving and emission reduction.

19.2. The distribution concerning the Shanghai Municipal Bureau of City Planning and Natural Resources. The Shanghai Municipal Bureau of Ecology and Environment is responsible for the guidance, coordination, and supervision of ecological protection and restoration; it takes charge of the red line of ecological protection. The Shanghai Municipal Bureau of City Planning and Natural Resources is responsible for taking the lead in the organizing and drafting of the ecological restoration plan on land space in Shanghai and the implementation of major projects relevant to ecological restoration; it organizes the delimitation of the red line of ecological protection and implements it.

19.3. The distribution concerning the Shanghai Water Authority. The Shanghai Municipal Bureau of Ecology and Environment takes charge of planning the divisions based on water functions, and takes charge of, supervises and guides the management of the setup of drain outlets. The Shanghai Water Authority participates in the matters mentioned above.

19.4. The distribution concerning the Shanghai Municipal Agriculture and Rural Affairs Commission. (1) The Shanghai Municipal Bureau of Ecology and Environment is responsible for the supervision and guidance in the treatment of agricultural pollution from non-point sources, guides, coordinates, and supervises the ecological and environmental protection in rural areas. The Shanghai Municipal Agriculture and Rural Affairs Commission is responsible for the organization and implementation of the treatment of agricultural pollution from non-point sources. (2) The Shanghai Municipal Bureau of Ecology and Environment supervises the protection of wild animals and plants citywide. The Shanghai Municipal Agriculture and Rural Affairs Commission is responsible for the protection of wild aquatic plants and animals.

19.5. The distribution concerning the Shanghai Landscaping and City Appearance Administrative Bureau. The Shanghai Municipal Bureau of Ecology and Environment supervises the implementation progress of the environmental supervision system in all kinds of nature reserves and the protection of wild animals and plants in the whole city. The Shanghai Landscaping and City Appearance Administrative Bureau supervises all kinds of nature reserves, implements relevant requirements concerning the management of the red line of ecological protection, and takes charge of the protection of wild land animals and plants.
