21.什么建设项目环评可以实行告知承诺制审批？
答
建设项目环评告知承诺审批是指公民、法人或其他组织提出建设项目环评文件的行政审批申请，生态环境部门一次性告知其审批条件和需要提交的材料，申请人以书面形式承诺其符合审批条件，由生态环境部门作出行政审批告知承诺决定的方式。
以下项目可以实行告知承诺制审批：
（1）全市范围内，在市生态环境局发布实施行政审批告知承诺的行业名单内的建设项目[21]。
（2）联动区域内，未纳入重点行业名录且原要求编制环评报告表的建设项目[8、13]。
（3）临港新片区产城融合区（不包括洋山保税港区岛屿部分）重点行业名录以外且原要求编制环评报告表的建设项目[10]。
（4）集成电路行业中，未列入重点行业名录，原要求编制环评报告表的建设项目 [12]。
（5）生物医药行业中，未列入重点行业名录，不涉及有毒有害污染物和新污染物排放且原要求编制环评报告表的建设项目[11]。
（6）长三角生态绿色一体化示范区内，告知承诺项目类别清单内的行业[22]。

A
EIA notification and commitment approval refers to a method where a citizen, legal person, or other organization applies for administrative approval of a construction project EIA document, the ecological environment department informs them of the approval conditions and required materials at one time, the applicant promises in writing that they meet the approval conditions, and the ecological environment department makes an administrative approval notification commitment decision.
The following projects can implement the Notification Commitment System approval:
(1) Citywide scope: Construction projects within the industry list published by the Municipal Bureau of Ecology and Environment for implementing administrative approval notification commitment [21].
(2) Within Linked Zones: Construction projects not included in the Key Industry Directory and originally requiring the compilation of an EIA Form [8, 13].
(3) Within Lingang Special Area Industry-City Integration Zone (excluding Yangshan Bonded Port Area islands): Construction projects outside the Key Industry Directory and originally requiring the compilation of an EIA Form [10].
(4) In the Integrated Circuit industry: Construction projects not listed in the Key Industry Directory, and originally requiring the compilation of an EIA Form [12].
(5) In the Bio-medicine industry: Construction projects not listed in the Key Industry Directory, not involving toxic/harmful pollutants or new pollutant emissions, and originally requiring the compilation of an EIA Form [11].
(6) Within the Demonstration Zone: Industries within the Notification Commitment Project Category List [22].

23.什么情况下，环评报告表可实行备案制？
答
环评报告表备案制是指对某些特定行业、特定区域且需编制环评报告表的建设项目，可由审批管理改为备案管理。以下建设项目可实行备案制：
（1）青浦区内符合规划环评要求、不增加重点污染物排放量、不新增建设用地的部分行业且原要求编制环评报告表的改扩建项目。（涉重点行业重点重金属、涉有毒有害污染物排放、涉新污染物排放等除外）[23]。
（2）临港新片区产城融合区（不包括洋山保税港区岛屿部分）内符合规划环评要求、属于备案管理目录清单内行业、纳入排污许可管理的持证单位、原要求编制环评报告表且不增加主要污染物排放量的“零增地”改扩建项目。建设单位应在项目建成并投入生产运营前完成报告表备案[10]。
（3）产业园区内的集成电路制造及配套行业的排污许可证持证单位，原要求编制环评报告表且不增加主要污染物排放量的“零增地”改扩建项目。建设单位应在项目建成并投入生产运营前完成报告表备案[12]。

The EIA Form Filing System refers to changing from approval management to filing management for construction projects in specific industries and specific regions that require the compilation of an EIA Form. The following construction projects can implement the Filing System:
(1) Reconstruction and expansion projects in Qingpu District in partial industries that meet planning EIA requirements, do not increase key pollutant emissions, do not add construction land, and originally required EIA Forms (excluding those involving key industry heavy metals, toxic/harmful pollutant emissions, new pollutant emissions, etc.) [23].
(2) "Zero land increase" reconstruction and expansion projects in the Lingang Special Area Industry-City Integration Zone (excluding Yangshan Bonded Port Area islands) that meet planning EIA requirements, belong to industries in the Filing Management Directory, are held by units included in pollution permit management, originally required EIA Forms, and do not increase major pollutant emissions. The construction unit shall complete the Report Form filing before the project is completed and put into production/operation [10].
(3) "Zero land increase" reconstruction and expansion projects for pollution permit holders in the Integrated Circuit Manufacturing and supporting industries within Industrial Parks, which originally required EIA Forms and do not increase major pollutant emissions. The construction unit shall complete the Report Form filing before the project is completed and put into production/operation [12].

答
申报单位应通过“上海一网通办”进入“建设项目环境影响评价审批”模块提交打捆编制的报告表的审批申请，申请材料与单个建设项目一致，审批部门受理、审批打捆项目的程序与单个建设项目程序一致，审批流程及时限按本市相关规定执行，在同一环评审批文件中对打捆的所有项目进行批复。

The declaring unit should enter the corresponding module via " Government Online-Offline Shanghai " to submit the approval application for the bundled Report Form.
